Withholding tax

We would like to clarify the withholding tax treatment for payments made from Malaysia.

Under Malaysian tax regulations, certain payments to non-resident suppliers are subject to withholding tax, which must be deducted at source by the payer. To avoid any administrative complications on both sides, we would like to confirm whether the invoiced amounts may be treated as net of Malaysian withholding tax, with the tax to be withheld from our payment.

In practical terms, this means:

• The invoice amount remains unchanged; and

• Payment will be made net of applicable withholding tax, which will be remitted to the Malaysian tax authority on your behalf.
